Council Room, Odell, Illinois, Monday, October 13, 2014, a Regular Board Meeting was held this date at 7:00pm., at Village Hall, Council Room, 213 S. Front Street, with Mayor Joyner presiding and with proper notice having been posted.
Roll Call
Roll call showed the following Trustee Members were physically present: Brian Verdun, Gary Wykes, Phaela Hodges, Matt Weaver and Herman Fearman.

Village Attorney Present: Ed Legner
Guests Present: Sgt. John Mitchell, Adam Dontz
Mayor Joyner called the meeting to order at 7:05pm., at which time a majority of a quorum was present

Mayor Joyner led the Pledge of Allegiance.
Minutes of the September 08, 2014 Regular Board Meeting

Minutes of the October 07, 2014 Special Board Meeting
Trustee Brian Verdun moved to approve the minutes of the October 07, 2014 Special Board Meeting as printed; second by Trustee Herman Fearman;

Treasurer’s Report
Iris Thorne, Clerk, reported that the Treasurer, Jim Rebholz, has supplied copies of an YTD Fund Summary and a MTD Treasurer’s Report. Bank balances for the month ending September 30, 2014 are as follows:

Iris Thorne reported, in reference to the Trails Grant, Tourism has received reimbursement in the amount $ 1,632.12, which is 80% of the total expenses submitted for the 1st and 2nd quarter of this calendar year.

Bills
Board Listing Report #800 ran on 10/10/14 at 1:55pm representing all due bills for the Village for October 2014, and Board Listing Report #801 ran on 10/10/14 at 2:44pm representing all due bills for Tourism for October 2014 were presented for payment approval.
Trustee Matt Weaver moved to approve and pay all bills on the Board Listing Report #800 ran on 10/10/14 at 1:55pm and Board Listing Report #801 ran on 10/10/14 at 2:55pm; second by Brian Verdun;

Police Report
Sgt. John Mitchell reported that there were 22 calls in Odell for last month; 0 citations; 2 warnings. St. Mitchell indicated that everything may not be entered into the computer so the citations and warnings could change. He also reported final counts for citations and warnings for the month of August were 3 and 4 consecutively.
OLD BUSINESS:
Elk Street Project
Mayor Joyner reported that with recent rains Elk Street is flooding again. The issued is tabled for the present. Next Spring the Village will look into the eligibility of funding the repairs through the Motor Fuel Tax Program.
Route 66 Trails Grant Update
Andrews has provided the final plans for the Route 66 Biking/Walking path, which were submitted to IDOT for approval last Friday, October 10, 2014.
Clearwell Update
The Clearwell update was moved to Executive Session.
Ordinance on Re-subdivision and Variance on Schott Property
Ed Legner indicated that he has prepared an Ordinance on the re-subdivision and variance on Jim and Diane’s property that was approved by the Board at the October 07, 2014 Special Meeting. No action is needed. Ed will see that the Ordinance and the plat of survey is recorded with the County Clerk.
Miscellaneous Old Business
No miscellaneous old business was discussed.
NEW BUSINESS:
Adam Dontz
Adam Dontz addressed the board regarding the next step for attracting new business and or expansion of present business in Livingston County. He presented his study of the tax rates and tax abatement programs offered in surrounding counties, both north and south of Livingston County. Adam also presented a draft of a property tax abatement incentive matrix. He indicated that this is just a draft and can be adjusted and that it applies to new construction only.
Discussion followed and Adam answered questions. Adam indicated that if the Board is interested in supporting a tax abatement program the next step would be to pass a Resolution of Support and to schedule a meeting with the other Odell taxing bodies.
Tree Bids
Mayor Joyner stated that we have received two bids on this year’s tree list as follows:
Trost Tree Experts $ 2,175.00
Dixon’s Tree Service $ 3,150.00
Trustee Brian Verdun moved to accept the bid from Trost Tree Experts of $ 2,175.00; second by Gary Wykes;

Tax Levy Ordinance
Ed Legner stated that he has prepared this year’s Tax Levy for a total sum of $ 71,885.35, which is a 5% increase over taxes received last year. The excess was all allocated to the IMRF line item.

Fence Removal Request
Mayor Joyner reported that a resident has inquired if an existing fence between two houses can be removed since there is a new owner of the property on which the fence is located. Discussion took place, and it was determined that this is a civil issue as the fence was in place before the Zoning Ordinances regulating placement of fences was enacted.
Miscellaneous New Business
Trustee Matt Weaver suggested that the Village commit to planting 10 trees in an effort to start replacing the trees that have been cut down the last few years.
Trustee Herman Fearman suggested that the Village consider bringing back Odell Days with one of the organizations in town. Possibilities were discussed.
Executive Session
Trustee Brian Verdun moved to go into executive session at 8:36pm for the purpose of discussing litigation updates involving the clearwell project; second by Trustee Herman Fearman;
