Official Minutes of the January 13, 2014 Regular Board Meeting

Village of Odell, Illinois

 

Council Room, Odell, Illinois, Monday, January 13, 2014, a Regular Board Meeting was held this date at 7:05pm., at Village Hall, Council Room, 213 S. Front Street, with Mayor Joyner presiding and with proper notice having been posted.

 

Roll Call

Roll call showed the following Trustee Members were physically present:  Mayor Terry Joyner, Brian Verdun, Gary Wykes, Jamie Johnson, Matt Weaver, and Herman Fearman

Staff Present: Iris Thorne & Rich Ribordy

Village Attorney Present: Ed Legner

Guests Present: Brian Mills, Sgt. John Mitchell, Scott and Debra Caldwell (to take photos)

Mayor Joyner called the meeting to order at 7:05pm., at which time a majority of a quorum was present

 

Pledge of Allegiance

Mayor Joyner led the Pledge of Allegiance.

 

Minutes of the December 09, 2013 Regular Board Meeting

Trustee Herman Fearman moved to approve the minutes of the December 09, 2013 Regular Board Meeting as printed; second by Trustee Brian Verdun;

Treasurer’s Report

Iris Thorne reported that the Treasurer, Jim Rebholz, has supplied copies of an YTD Fund Summary and a MTD Treasurer’s Report.  Bank balances for the month ending December 31, 2013 are as follows:

Trustee Jamie Johnson moved to approve the Treasurers report; second by Trustee Brian Verdun;

Bills

Board Listing Report #759 ran on 01/13/14 at 12:55pm representing all due bills for the Village for January 2014, and Board Listing Report #760 ran on 01/13/14 at 1:20pm representing all due bills for Tourism for January 2014 were presented for payment approval. Mayor Joyner also presented an invoice from Farnsworth for $2,037.50 for the Clearwell Exfiltration Test and $730.00 from Koerner for calibration services.

 

Trustee Matt Weaver moved to approve and pay all bills on the Board Listing Report dated
January 13, 2014 ran at 12:55pm, list #759, and Board Listing Report dated January 13, 2014 ran at 1:20pm, list #760; second by Trustee Brian Verdun;

Police Report

Sgt. John Mitchell reported that according to the December 2013 Police Activity Report there were 14 calls; 1 warnings; and 0 citations issued during the month of December.  Sgt. Mitchell noted that in February he will be at our meeting at a later time during the evening.

 

OLD BUSINESS:

 

Ambulance

Brian Mills, representing the Ambulance Committee, updated the board on the proposed Tax Referendum.  The Ambulance Committee is asking for volunteers to help educated the community and donations to defray the cost of posters, postage, education material etc….

Brian also advised that the next committee meeting is January 23, 2014 at 7:30pm and there will be a town hall meeting January 28, 2014 at 7:00pm, both meetings will be held at the Odell Fire Station.

 

Trustee Jamie Johnson moved that the Village donate $1,000 to the Ambulance Service; second by Herman Fearman;

Garbage Contract

Ed Legner stated that he has been in contact with Allied Waste regarding our contract.  Allied is working to clear up issues on the contract.  The contract was tabled until next month.

 

Planning Commission Recommendation

Mayor Joyner informed the board that since our Village Attorney, Ed Legner, represents Graymont Bank Trust Department, there is a conflict of interest and the Village will need to seek independent counsel for the subdivision petition that was referred to the Planning Commission last month.  Mayor Joyner advised that he recommends Attorney Irvin Masching.

 

Trustee Herman Fearman moved to approve Irvin Masching as independent counsel to represent the Village in the subdivision request; second by Jamie Johnson;

Water/Sewer Rates

Rich Ribordy presented his research on a new meter system for the Village.  Rich went over all the features of the newest mechanical meter versus the newest electronic meter.  The board discussed at length which meter would be financially, economically and beneficially feasible for the Village.

 

Trustee Matthew Weaver moved to purchase the initial software system with the add-on of the $300 visual reader display touch pad and a number of meters, not to exceed $20,000; second by Gary Wykes;

Intergovernmental Agreement

Mayor Joyner indicated that the Village has received the final draft of the Intergovernmental Agreement with the State of Illinois for the Route 66 Trails Grant.

 

Trustee Herman Fearman moved to approve the Intergovernmental Agreement with the State of Illinois for the Route 66 Trails Grant; second by Jamie Johnson;

Clearwell

Attorney Ed Legner advised that the closeout date for the Grant the Village received to complete the Clearwell is June 30, 2014.  Attorney Legner advised to have our grant administrator, Paul Brown, to apply of an extension of that closeout date to June 30, 2016.

 

Trustee Jamie Johnson moved to extend the Grant closeout date to June 30, 2016; second by Brian Verdun;

The clearwell litigation discussion was moved to executive session.

NEW BUSINESS:

 

Livingston County Support Request

Mayor Joyner stated that the Livingston County Board is asking for the Village’s support in the form of a letter for a Brownfield Grant Application.

 

Trustee Jamie Johnson moved that we offer our support in the form of a letter, not that we would name anything specific, but add some sentences to the letter indicating that we may potentially have some issues here; second by Matthew Weaver;

Miscellaneous New Business   (for discussion only)

Gary Wykes is donating to the Village a book of 100 years of the history (1862 – 1962) of the Congregational Church; a book of recollections of John McWilliams, who started the first bank in Odell; a journal written by Maude Wykes Bradshaw of Odell history and a framed certificate of the appointment of Otis Wykes as Police Magistrate in 1959.

 

Executive Session

 

Trustee Jamie Johnson moved to go into executive session at 8:56pm for the purpose of discussing litigation updates involving the clearwell project; second by Trustee Brian Verdun;
